Marriage Act

Pursuant to Article 212 D (k) of the Constitution of the Cooperative Republic of Guyana, the Ethnic Relations Commission (ERC) has the mandate to monitor and review all legislation ‘…having implication for ethnic relations and equal opportunities…’ To this end, the ERC wishes to advise the public the following:

The relevant subject Minister may appoint anyone of any religious denomination to be a marriage officer in Guyana, with the requisite empowerment to act in such a capacity throughout Guyana. Such an officer may only solemnise a marriage according to the rules of the religious denomination to which he/she belongs. This however, does not preclude the marriage officer from performing a marriage ceremony on anyone of another religious background/denomination, providing that the marriage ceremony is carried out according to the rules of the denomination to which the marriage officer belongs.

Further, it has come to the ERC’s attention that a person’s surname is being used to identify that person as being of a particular denomination and/or ethnicity. The ERC wishes to advise the public that this may not necessarily be correct and urges that this practice cease immediately.
